China Copyright Administration strengthens supervision of NFT digital collections

On September 9, 2022, the National Copyright Administration officially released the "Jianwang 2022" special action launched by four departments including the National Copyright Administration. The article mentioned strengthening the copyright supervision of NFT digital collections, "script killing" and other new online formats, severely cracking down on unauthorized use of others' art, music, animation, games, film and television works to cast NFTs, produce digital collections, sell pirated script scripts through the internet, and develop script image props without authorization.
 
 

This special action will be carried out from September to November, focusing on the urgent and difficult issues in the copyright field of the majority of innovative entities, promoting standardized development and cracking down on punishment. Four key areas will be targeted for rectification: first, special rectification will be carried out in key areas such as literature databases, short videos, and online literature. Unauthorized and unauthorized use of literature databases to disseminate other people's works, unauthorized deletion and editing of audiovisual works, adaptation and compilation of short videos, and unauthorized dissemination of online literary works through websites, social platforms, browsers, search engines will be centrally rectified. The second is to strengthen the supervision of copyright on online platforms, investigate and punish the sale of infringing products through short video platforms, live streaming platforms, and e-commerce platforms in accordance with the law, resolutely rectify the abuse of the "safe harbor" rule of infringement, strengthen the main responsibility of online platforms, timely dispose of infringing content and repeatedly infringing accounts, and facilitate the rights holders to protect their rights in accordance with the law. The third is to strengthen the copyright supervision of NFT digital collections, "murder mystery" and other new online formats, and crack down severely on unauthorized use of others' art, music, animation, games, film and television works to cast NFTs, produce digital collections, sell pirated script scripts through the internet, and develop script images and props without authorization. Fourthly, we will continue to strengthen the protection of copyright for cinema films, live streaming, sports events, online education, and news works, consolidate the achievements of work in the fields of online music, games, anime, audiobooks, and online storage, and continuously improve the effectiveness of online copyright law enforcement.

The person in charge of the relevant department of the National Copyright Administration stated that the special action will closely focus on the main line of welcoming and implementing the 20th National Congress of the Communist Party of China, adhere to seeking progress while maintaining stability and innovation, strengthen the full chain protection of online copyright through promoting standardized development and cracking down on punishment, accelerate the creation of a market-oriented, rule of law, and international business environment, and provide copyright work support for promoting entrepreneurship and innovation, promoting the standardized, healthy, and sustainable development of the platform economy, and ensuring and improving people's livelihoods.
